Is porn protected by Copyright Laws?

People across the country are being sued for sharing their pornography with their peers online. Hard Drive Production, a porn studio, is one such company that is going after people they feel is downloading their content illegally and sharing it with others. However, Ms. Liuxia Wong, a California resident, is fighting back. She received a notice from Hard Drive Production alleging that she used her IP address to share the file “Amateur Allure Jen” on BitTorrent on March 28, 2011. The letter stated that they were going to take her to court for $150,000 for copyright infringement, or she can settle with them for $3,400. They also claim that Ms. Wong would still be indicted even if her router was unsecure and someone else uploaded the file on BitTorrent. Ms. Wong has now hired an attorney and is looking to take the matter to court.

In her defense, Ms. Wong and her lawyers are arguing that the movie “Amateur Allure Jen” was not released until April 22, 2011, but they have her sharing the before he actual release date. She is also arguing that porn is not protected by any copyright laws. The Us Constitution defines the purpose of copyright, which is “To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.” They also noted that an “Early Circuit law in California found that obscene works did not promote the progress of science and the useful arts, and therefore Hard Drive Production’s pornography movies cannot be protected by copyright laws. She also addressed the fact that she can be held liable even if her router was unsecured and it was uploaded by someone else. She is asking the courts not hold her liable for copyright infringement and to rule that Hard Drive Production’s content is not Copyrightable.

Be mindful of your file sharing online. Make sure you are not downloading, uploading or sharing questionable copyrighted materials. You could be the next one that receives a letter from Hard Drive Production. This ruling could affect the adult industry in California, so Hard Drive Production maybe in for a fight. Condoms Required in Porn?

Adult video set the tone for swinger’s events and is normally the entertainment of choice. The presence of porn at swinger events is here to stay, but you may start to see more porn flicks practicing safer sex. This is because the Los Angeles city council has voted 9 – 1 denying film permits to producers who choose not to comply with a condom requirement. There is currently a law in the state of California that requires condoms to be used on adult films sets, but supporters are saying the law is not being enforced.

On one hand, the AIDs Healthcare Foundation, supporters of this issue, is stating that the new law is needed because the existing law was not being enforced by the adult industry. While on the other hand, industry leaders are saying that they are already doing their own policing by requiring actors to be tested for STD’s every 30 days when working. This new law that is being introduced would require film producers to use a condom during filming and pay a fee that would then pay for surprise inspections to these films sets to make sure that the law is being properly enforced. A majority of the adult films are made in the San Fernando Valley area, but that could change with this law.

Industry leaders are saying this would hurt their business. They say that condoms in adult movies would ruin the fantasy and can be very distracting, while others are saying that this is not something the international audiences would want to spend their money on and that could really hurt their bottom line. The National Coalition for Sexual Freedom (NCSF) started back in 1997 by a small group led by Susan Wright. Swinging and Polyamory

Is there a difference between swinging and polyamory? The answer is YES, but are they similar, kind of, let me explain. First off in polyamory is a desire, practice or accepting the fact that you are in more than one relationship, whereas swinging you are in a relationship with a spouse/significant other and both allowed to play. There are multiple types of the poly lifestyle, such as polygynous and polyandrous. In order to understand polyamory you need to understand the two different types. First up is polygynous, which refers to one husband that has multiple wives. Next up is polyandrous, in which one wife has multiple husbands, although less common it does exist.

In a swinging relationship both the man and woman are faithful in a relationship to each other, but allowed to play, and are not married to more than one person. Some swingers and polyamory relationships have a live in person. That three people together in the relationship is known as a triad. People who identify as polyamorous typically reject the view that sexual and relational exclusivity are necessary for deep, committed, long-term loving relationships. Sex is not necessarily a primary focus in polyamorous relationships. In swinging, there is usually lots of sex involved, and as mentioned polyamory is defined as rejecting the view that sex is needed for a long term relationship. Swingers are in long term relationships, and get into the lifestyle to create a better bond, add spice to the relationship etc.

Swinging lifestyle entails variety of sexual experiences that entails is having recreational sex with other people other than your partner. Even if it is repeated many times with the same partner, most of the swingers believe that there is no strong attached. One of the excitements of this is trying new people for the first time. There is that excitement of first touch, first kiss and first everything. You can create the same excitement in the second and third touch but as time goes, that excitement dulls then it’s over.

Polyamory relationship are different from a swinging relationship. In polyamory relationship, commitment is between multiple partners while a swinging relationship, there is only one committed relationship and that is with the couple. Others coming to play are not thought of as a serious relationship and wit would server for them to remember that. It is not a bad idea to have friends as swinging partners, but all parties should be aware and not look for more than what is really there, just people having sex.

If you are in a swinging relationship and want to break it off with the other couple, contact the couple you are dating and inform them that you want to talk to them about your relationship. You can just talk to them immediately or schedule a time to talk. When you meet them, break it to them gently and remain amicable. The swinging community is small and a close-knit group. You are likely to run into them later and you have to be careful just to spare hard feelings moving forward. Chances are they wanted to tell you the same but did not know how to tell you. It is also important to be aware that they are people with feelings and as swingers, this have to be considered.
